Steve Ensminger, Jr., the husband of late WDSU sports reporter Carley McCord, is filing a lawsuit related to her death in the Lafayette plane crash last December.

According to WDSU, Ensminger filed a lawsuit May 6 in Lafayette against the plane owners.

The suit claims the owners and operators were "negligent in the selection, operation, maintenance, custody, and control of the plane and that they posed an unreasonable risk of harm to McCord and other passengers."

It continues, "Upon learning that a crash was imminent, though the moment of her untimely death onboard PiperN42CV, Carley McCord Ensminger experienced severe emotional trauma and panic, as well as shock and damage to her nervous system and psyche." McCord suffered from acrophobia, known as the fear of flying, which contributed to the trauma, according to the lawsuit.

Low visibility is noted in the suit and claims owners and operators failed to properly inspect the conditions, and claims the pilot lacked experience or training to fly in those conditions.

Ensminger is seeking damages for, among others, wrongful death, mental anguish, and, on behalf of McCord, bodily injuries and suffering.

McCord and four others were killed in December when their plane crashed on Feu Follet Road in Lafayette shortly after takeoff. They were heading to the Peach Bowl in Atlanta.

KATC will have more details on this story when they become available.
