New Iberia contractor pays nearly $250K to employees for Fair Labor Act violations

A New Iberia electrical contractor has paid $249,278 in back wages to 117 employees for violating the Fair Labor Standards Act, according to the U.S. Department of Labor.

Investigators with the department’s Wage and Hour Division found Ernest P. Breaux Electrical LLC violated overtime and recordkeeping requirements. According to the investigation, the company wrongly classified employees as independent contractors and failed to pay them overtime when they worked more than 40 hours in a workweek. The company was also found to have kept inaccurate payroll records as required by federal law.

According to the department, Ernest P. Breaux Electrical LLC fully cooperated with the investigation and has put measures into place to avoid future violations.
