The Eunice High School teacher accused of sending seminude of herself to a student is asking a judge to reduce her charges. Jacqueline Frugé is charged with prohibited sexual conduct between educator and student. In a motion filed in Eunice City Court, Frugé's lawyer claims that even if the allegations made by police and the alleged victim were proven to be true, they would not meet the legal definition of the charge. The motion quotes state law to support this claim, saying a "lewd and lascivious act" was not committed "'upon the student' or "'in the presence of' the student 'with the intention of gratifying the sexual desires of either person."
Frugé was arrested in December after police were notified of the pictures. A motions hearing is scheduled for June 17. Trial is slated to begin on July 1.
