NEW ORLEANS (AP) - The Louisiana Supreme Court has extended a stay allowing New Orleans to continue issuing tickets based upon traffic cameras while it considers an appeal on their legality.
The cameras were successfully challenged in a lawsuit brought by
Edward Washington, a former deputy city attorney, who argued that
the city charter states that police, not the public-works
department, is in charge of regulating traffic.
A state judge issued an injunction Oct. 1 barring the city from
using the devices, which generate tickets for speeding and
red-light infractions.
The 4th Circuit Court of Appeal granted the city an emergency
stay, but then sided with district judge in considering the appeal.
The Times-Picayune reports it is not clear when the Supreme
Court will consider the matter.
