NEW ORLEANS (AP) - Prosecutors have asked the Louisiana Supreme
Court to overturn an order for a new trial for the man accused in a
shooting spree that killed five teenagers.
The Times-Picayune reports that the 4th Circuit Court of Appeal
ruled 2-1 this week that Criminal District Judge Lynda Van Davis
acted properly in granting Michael Anderson a new trial. She said
prosecutors should have given Anderson two pieces of evidence.
One was a videotape of the only prosecution witness saying she
was at the scene hours after the teens were gunned down. The other
was a plea agreement with a jailhouse snitch.
Judge David Gorbaty wrote in his dissent that Davis should not
have granted a new trial because there was no injustice done.
