The defense attorney for Seth Fontenot is asking a judge to postpone November's scheduled murder trial so the defense can get a decision on appeals it has filed and set up expert witnesses to testify on Fontenot's behalf.
Currently, Fontenot's trial is set to begin on Nov. 12. Lafayette attorney Tommy Guilbeau filed a motion Thursday asking Judge Kristian Earles to push back that date.
Last week, Guilbeau filed a request to have statements made by one of the two teens who were wounded during the incident sealed after the court allowed the defense to view the interviews.
Earles ruled on Aug. 29 the initial interview with Fontenot after the shooting would be allowed into evidence, despite defense claims that he did not know he was a suspect at the time of the interrogation.
Fontenot is accused of killing 15-year-old Austin Rivault and injuring two other teens after shooting at their vehicle. He's facing charges of first degree murder and two counts of attempted first degree murder.
