A man charged with OWI and vehicular homicide was arrested and again charged with OWI. A Lafayette Police officer pulled over 49-year-old Dallas Fabre Thursday morning around 2:08 for driving 58 in a 40 mph zone, according to an arrest affidavit. The officer said he smelled alcohol when he pulled over Fabre in the 4900 block of Johnston St. Fabre "admitted to consuming alcoholic beverages and being under the influence of Xanax," the affidavit said.
According to the affidavit, when Fabre was taken to the Lafayette Police Dept., a breath test revealed his blood alcohol content was .07, which is below the legal limit of .08. Fabre refused to submit blood or urine for further analysis.
Fabre is accused of being drunk when he ran a stop sign in Nov. 2010 and crashed into 65-year-old Bobbie Tinker, of Abbeville. Tinker died in the crash, and State Police charged Fabre with vehicular homicide on May 27, 2011. He's scheduled to be in court for pretrial motions for the that charge on March 28.
