The Third Circuit Court of Appeals reversed a ruling that calls the town of Henderson's attempt to annex land unreasonable. The case will now head back to district court.
Area businesses sued the town after town leaders passed an ordinance to annex about 46 acres of land at Exit 115. They claim the only reason the town wants the land is to gain revenue and that the town can't provide services to the area to be annexed. For those reasons, the plaintiffs said the annexation was unreasonable.
The Third Circuit's ruling reverses a 2012 district court ruling.
