The public defenders for a murder suspect want a judge to prevent prosecutors from using their client's criminal history against him if he is convicted. Ronjoerox Hamilton is charged with first-degree murder in the death of nine-year-old Dylan Royer. Hamilton's attorney's say prosecutors failed to turn over victim impact statements and "prior bad acts evidence" to them before an April 15 deadline. Hamilton's lawyers say this adversely affects their ability to defend him and "threatens his (constitutional) rights." The prosecution responded by saying it would present evidence from some of Hamilton's prior cases.
A pre-trial hearing is set for May 16. The trial is scheduled to begin on October 7.
