Grandparents Facing Charges for Kidnapping Grandson

A Texas woman accused of kidnapping her own grandson is now out on bond. 45-year-old Rebecca Foster is charged with simple kidnapping for keeping her 3-year-old grandson, Joshua Lowe, away from the Department of Children and Family Services. DCFS was granted legal custody of the boy last week.

Foster is one of two grandparents charged in this case. The boy's grandfather, Monty Wilson, also turned himself in. Wilson was arrested and bonded out Thursday on the same charges.

Last week a Lafayette judge ordered 3-year-old Lowe be turned over to the custody of the state. Allegedly his grandfather, Monty Wilson, and grandmother, Rebecca Foster, kept him from authorities.

"According to the Louisiana kidnapping law, anytime the court intervenes and assigns custody of a child anyone, whether it be a parent or a grandparent, anyone who interferes with the order of the court can be charged with simple kidnapping," said Cpt. Kip Judice with the Lafayette Sheriff's Office.

Both grandparents turned themselves in and were charged with simple kidnapping. Wilson on Thursday with a bond of $5,000. Foster on Friday with a bond of $50,000.

"Now certainly in regards to her a lot of effort was put forth," said Judice. "There were search warrants executed in Texas. We believe she was in the state of Texas and drove back to Lafayette yesterday."

Foster called deputies Friday night and turned the boy over to authorities.

"The child was very jovial last night. He was playing with police officers flashlights. He was a little hungry, we provided him with some food, but beyond that, the child is in very good physical condition. I don't think anyone alleged there was a physical threat to the child," said Judice.

At this time it's unclear why the judge ordered the boy to be turned over to state custody. He will remain in their custody until a hearing on Monday. If convicted they both could be fined up to $5,000 and serve up to five years in prison.
