Statements Seth Fontenot made to police following the shooting death of a Lafayette teenager can be used in his trial.
The Third Circuit Court of Appeal issued that ruling today. Fontenot is accused of killing 15-year old Austin Rivault and injuring two other teens after allegedly shooting at their vehicle.
Fontenot's attorney claims his client's statements to police shouldn't be used because Fontenot didn't know he was a suspect at the time. Fontenot was allegedly told halfway through questioning that someone had died.
Judge Kristian Earles ruled in September the statements could be used. The Court of Appeals agreed with that decision this week. Trial is set for November 12th.
