Brandon Scott Lavergne Files to Have Conviction Dismissed (PDF)

Brandon Scott Lavergne's request to have his conviction and sentence thrown out have been denied by a district judge. In an order filed January 2, Judge Herman Clause remanded the petition back to Lavergne because it was not filed in compliance with state law. The order says Lavergne may re-file his petition once it is in compliance with state guidelines.

Lavergne's petition alleges--among others--an improper venue for the Lisa Pate case, a tainted jury pool due to media coverage of the Mickey Shunick case, and inadequate counsel from his court-appointed attorneys.
